These Terms of Service ("Terms") govern your access to and use of the AI-powered UGC video, audio, avatar, and related content generation services provided by SnapUGC ("SnapUGC", "we", "us"). By accessing the Platform, creating an account, purchasing a subscription, using credits, or starting any generation request, you agree to these Terms.

1. Scope of the Service

SnapUGC is an online platform that helps users create AI-assisted ads and UGC content from prompts, images, product information, brand guidance, audio, avatars, and similar inputs.

Available features may vary based on your plan, credit balance, technical capacity, regional availability, and third-party provider availability. SnapUGC may add, change, suspend, or remove features at any time.

2. Third-Party AI Providers

SnapUGC does not run video or audio inference on its own GPU infrastructure. To provide the Service, user inputs, generation requests, and technical metadata may be sent to third-party AI providers.

The providers and models we use may change over time. Examples include ElevenLabs v3 audio technologies and HeyGen Avatars services.

By using the Service, you acknowledge and agree that:

  • generation requests may be transmitted to relevant third-party providers,
  • those providers may apply their own terms, usage policies, safety rules, and technical limitations,
  • SnapUGC is not directly responsible for provider-caused delays, errors, quality differences, model changes, downtime, or refusal decisions,
  • SnapUGC may reject requests, remove outputs, or limit account access to comply with provider rules or legal requirements.

3. Account, Security, and Authorized Use

You must provide accurate, current, and complete account information. You are responsible for keeping your login credentials secure, for all activity under your account, and for access granted to your team members.

You may not allow unauthorized account use, bypass security controls, or overload the Platform with automated or abusive requests. SnapUGC may temporarily or permanently restrict your account in case of suspicious use, payment risk, security incidents, or policy violations.

4. User Inputs and Generated Content

You are responsible for prompts, images, product information, brand materials, audio, avatars, faces, names, logos, and other content that you upload or provide to the Platform. You represent that you have all rights, permissions, and consents required to use, process, reproduce, and transmit those inputs to AI providers.

SnapUGC may process user inputs and outputs to provide the Service, process generation requests, create outputs, run safety and abuse checks, troubleshoot technical issues, and improve service quality.

You are responsible for using generated content in compliance with laws, ad platform rules, intellectual property rights, personality rights, consumer protection rules, and applicable industry requirements. SnapUGC does not guarantee that generated content will be accepted by any advertising platform, achieve any performance result, or be free from third-party rights claims.

5. Prohibited Uses

You may not use the Service to:

  • generate illegal, misleading, fraudulent, harmful, hateful, harassing, violent, sexually exploitative, or personally unsafe content,
  • impersonate real people without permission or use deepfake, avatar, voice cloning, or similar technologies to misrepresent a person,
  • use materials that may infringe copyrights, trademarks, design rights, trade secrets, personality rights, or privacy rights,
  • create misleading or non-compliant claims in high-impact areas such as health, finance, law, political advertising, employment, credit, housing, or similar fields,
  • create content that violates child safety or exploits minors,
  • bypass safety controls, usage limits, content filters, or provider policies,
  • use the Service for spam, malware, phishing, unauthorized data collection, or system abuse.

SnapUGC may review, reject, or remove suspected prohibited content, refuse credit use, suspend accounts, or share information with competent authorities where required.

6. Nature of AI Outputs

AI outputs are generated by probabilistic systems. The same input may produce different results, and faces, voices, products, logos, text, captions, movement, duration, resolution, language, pronunciation, or scene consistency may not always match your expectations.

SnapUGC and its third-party providers do not guarantee that outputs will be error-free, uninterrupted, unique, lawful, fit for a specific commercial purpose, or successful in advertising performance. You are responsible for reviewing all outputs before publication, making any required edits, and deciding whether the output is suitable for your intended use.

7. Credits, Subscriptions, and Payments

Plans, credit amounts, features, prices, billing periods, and usage limits apply as shown on the Platform. SnapUGC may use third-party payment services such as Stripe and, where applicable for legacy accounts, prior payment providers.

Subscriptions renew according to the selected billing period. If you cancel your subscription, renewal stops; access may continue until the end of the current period according to your plan terms. Unless expressly stated on the Platform, unused credits do not roll over, have no cash value, and may not be transferred to another account.

Credits may be consumed when a generation request is started, accepted for processing, or sent to a third-party provider. SnapUGC does not guarantee credit refunds for requests that were processed, rejected, delayed, failed, or produced results that did not meet your quality expectations.

8. Cancellation and Refund Policy

Except where mandatory law requires otherwise, subscription fees, purchased credit packages, used or unused credits, started generation jobs, and requests sent to third-party providers are non-refundable.

Cancellation only stops renewal for future billing periods. Fees for the current period are not refunded because of unused time, unused credits, dissatisfaction, provider delays, output quality, model changes, or account restrictions caused by user violations.

Where mandatory consumer rights apply, the applicable legal requirements will control.

9. Service Availability and Changes

The Service may be delayed, interrupted, or unavailable because of maintenance, updates, demand spikes, network issues, payment provider issues, third-party AI provider outages, security incidents, or force majeure events.

SnapUGC may apply rate limits, usage limits, queues, prioritization, content review, or access restrictions to protect service quality, prevent abuse, or comply with provider limits.

10. Intellectual Property

The SnapUGC Platform, interfaces, software, designs, brand elements, workflows, and technical systems are owned by SnapUGC or its licensors. These Terms do not grant you ownership rights in the Platform.

You retain your rights in your user inputs. Your right to use generated content is limited by applicable law, third-party provider terms, the rights attached to your inputs, your plan terms, and these Terms.

11. Limitation of Liability

SnapUGC will use reasonable care in providing the Service, but the Service is provided "as is" and "as available." To the maximum extent permitted by applicable law, SnapUGC is not liable for indirect damages, lost profits, lost revenue, reputational harm, data loss, ad account restrictions, third-party claims, or consequences arising from your use of AI outputs.

You agree that you are solely responsible for the legal, commercial, and operational consequences of content you create and use through the Platform.

12. Changes and Termination

SnapUGC may update these Terms from time to time. Updated Terms take effect when published on the Platform. Continued use of the Service after an update means you accept the updated Terms.

SnapUGC may suspend, terminate, or limit access to your account in case of payment failure, security risk, prohibited use, provider policy violation, legal obligation, or abuse of the Platform.

13. Dispute Resolution

These Terms are governed by the laws of the Republic of Turkey. Istanbul Courts and Enforcement Offices have jurisdiction over disputes arising from these Terms.
